Family Wins 2nd Appeal In Wrongful Death Of Boy

A Lake County family has won at least $9 million in a medical malpractice case involving the death of a 12-year-old boy.
Andrew Muno of Wildwood was undergoing surgery at Condell Medical Center in Libertyville to repair a cut tendon on his left arm when he died on Dec. 14, 1999. Andrew died after suffering breathing problems when he was administered an antibiotic he was allergic to, according to a release from the Salvi, Schostok & Pritchard law office, which represented the Muno family.
The family filed a wrongful death lawsuit against anesthesiologist Dr. Dale S. Gordon and the surgeon who worked on their son.
In 2006, a Lake County jury ruled in favor of the family, awarding $7.5 million for the wrongful death of their son.
Following the ruling, Dr. Gordon and Lake County Anesthesiologists attempted to challenge the verdict twice -- once before the Appellate Court and then the state Supreme Court -- with no success, according to Christina Solomon, a spokesman for the law firm.
On Wednesday, Lake County Judge Raymond McKoski upheld the initial award plus interest granting the family more than $9 million.
"After nine years of waiting for justice to be rendered for the death of their son, the Muno family is relieved to finally have closure of this horrible chapter in their lives," attorney Michael Schostok said in the release.
