Immigrant Activist To Seek Order Barring Removal

Elvira Arellano Holed Up Inside Chicago Church

CHICAGO (AP) ― A lawyer for an immigration activist who has taken refuge in a Chicago church to stop the government from sending her back to Mexico says he'll ask a judge to block her deportation.

Attorney Joseph Mathews says he plans to request a temporary injunction tomorrow in the case of 31-year-old Elvira Arellano. She was arrested four years ago after entering the country illegally.

Mathews says he'll ask the court to declare that deporting Arellano would effectively lead to the deportation of her seven-year-old son and so violate his rights as an American citizen.

Arellano was scheduled to surrender to authorities Aug. 15 but sought sanctuary in the church instead.

She and her supporters say only a court order can stop the government from forcibly removing her from the church.
