One of the two University of Illinois trustees who haven't offered to resign says he'll fight Gov. Pat Quinn if the governor tries to remove him.
Trustee James Montgomery said Tuesday he would seek an immediate injunction to stop Quinn.
Quinn says he'll act Wednesday against Montgomery and Frances Carroll. Both have refused Quinn's demand that trustees step down as part of the scandal over allegations that political clout was used to get less qualified students into the school.
Montgomery and Carroll are the only holdouts.
Montgomery says he'll try to force the governor to prove in court that Montgomery was incompetent, neglected his duties or was guilty of malfeasance. The state constitution says political appointees may be removed for those reasons.
