A Cook County correctional officer fired for allegedly sucking two female inmates' toes has filed a complaint in an effort to get his job back.
Gary Grabitz filed a complaint for administrative review Thursday in Cook County Circuit Court against the Cook County Sheriff's Merit Board and Cook County Sheriff Thomas Dart after the board terminated his position in 2006.
According to the original decision from the Cook County Sheriff's Merit Board, it was determined by an investigator that Grabitz solicited two inmates and sucked their toes while on-duty. The information was reported by a third inmate.
One witness gave investigators a "detailed, credible account" of the incident. The witness, who was in federal custody in McHenry County, identified Grabitz and fully explained how she was approached by him and the details of what happened between him and two women inmates.
Grabitz claims the Merit Board's decision was "arbitrary and legally erroneous." The complaint also states the board did not properly weight the evidence presented and lacked the legal authority to terminate his position.
Grabitz is seeking for a review of his case and for the board to restore his position as a correctional officer with full back-pay and benefits. He is also seeking an undisclosed amount of money.
Grabitz had been employed by as a correctional officer from 1989 until his termination in 2006.
