$6.5M To Baby In Malpractice Suit Settlement

AURORA, Ill. (Sun-Times Media Wire) ― A $6.5 million settlement has been reached on behalf of a 7-year-old west suburban boy who allegedly suffered a brain injury at birth at an Aurora Hospital.
Attorneys for Roberto Morales Jr. of Aurora say the attending obstetrician, as well as the labor and delivery nurse, failed to respond to the baby's low heart rate and reduced oxygen flow caused by the drug Pitocin.

The settlement was reached Friday in Cook County Circuit Court. Morales was treated at Provena Mercy Medical Center on April 7, 2001.

Attorney Mark McKenna of McKenna & Mertz said the suit was filed in Cook County because Morales received the bulk of his care at a Cook County hospital. He was flown to Advocate Lutheran General Hospital in Park Ridge after delivery and remained there for a month, McKenna said.

Roberto was born with metabolic acidosis and hypoxic ischemic encephalopathy.

The settlement amount will pay for this continued health care, the attorney said. Morales was diagnosed with cerebral palsy and has limited mobility.

Plaintiffs in the case were Park National Bank and the boy's mother, Joann Williams of Aurora, as co- guardians of Morales' estate. Defendants were Provena Mercy Medical Center, Dr. Judson Jones, the obstetrician; Dreyer Medical Group Ltd., Dreyer Clinic Inc. and Advocate Health Care Network, McKenna said.
